The Legal Part

In order to stay at Xenia long term (over 30 days) you will be asked to sign a Licence Agreement, this is a legal document between you and Chapter 1. Please see the details below and contact us if you have any questions.

Licence Agreement (Excluded)

1. General terms

1.1 Christian Alliance Housing Association Limited, trading as Chapter 1 ("Chapter 1") of 2 Exton Street, London SE1 8UE grants:___________ ("You")

Licence:

(i) To occupy a room:

initially Room No: _____________ (the "Room"), along with furniture, furnishings, fixtures and other items (the "Contents") listed in Schedule 1. The Room is in that part of 2 Secker Street, London SE1 8UF used as a student hostel ("Xenia"), which is in part of a building owned by Chapter 1 (the "Building").

and

(ii) To use:

the shared communal areas which are part of Xenia such as (but not limited to) any access paths, stairways, lifts, communal gardens, balconies, landings, wash rooms and parking areas but excluding the communal lounges and IT/ study rooms (the "Communal Areas")

on the terms and conditions in this agreement (the "Licence"); and

(iii) To use:

the communal lounges and IT/study rooms at Xenia

on the terms and conditions in this agreement (the "Communal Lounge and Study Room Licence").

Start date

1.2 The Licence and the Communal Lounge and Study Room Licence (the "Agreement") begin on:___________

1.3 The Licence and the Communal Lounge and Study Room Licence is for a:

fixed term, of 39 or 51 weeks which ends on: _________ (the "Fixed Term") unless it is brought to an end earlier under the terms of this Agreement.

The Services

1.4 Chapter 1 will provide You with the services listed in Schedule 2 (the "Services").

1.5 If Chapter 1 provides You with any services not listed in Schedule 2 they will be covered by their own terms and conditions in a separate agreement.

The Contents

1.6 Chapter 1 will provide You with the Contents.

What it costs to stay at Xenia

1.7 You have to pay a licence charge to stay at Xenia for the Fixed Term of  _____________ (the "Licence Charge"), which includes the price of providing the Services and the Contents. The Licence Charge is payable in full or in 3 or 4 instalments (the "Payment Schedule") as set out below:

The first payment of   is due on or before  
The second payment of   is due on or before  
The third payment of   is due on or before  
The fourth payment of   is due on or before  

1.8 You must also pay a Deposit of £ ___________(the "Deposit") to Chapter 1 before You move in, as security towards the payment of any sums due by You to Chapter 1. The Deposit will be managed as set out below.

Interest on sums not paid

1.9 You will pay interest at the rate of 3% per year calculated on a daily basis (the "Interest Rate") on any late Licence Charge or other payment lawfully due under this Agreement until the date of actual payment.

The Deposit

1.10 Chapter 1 will not pay You any interest on the Deposit.

1.11 The following sums (the "Deductions") may be paid out of the Deposit to Chapter 1:

  1. any Licence Charge or other payments due by You to Chapter 1;
  2. any reasonable sum Chapter 1 spends in putting right any failure by You to comply with Your obligations under this Agreement;
  3. any amount which You owe at the end of the Agreement to Chapter 1 for any unauthorised occupation by You or anyone allowed into Xenia by You, at a rate equivalent to the Licence Charge;
  4. any interest due under this Agreement on any of the above sums at the Interest Rate from the date the payment is due to the date it is deducted from the Deposit; and
  5. any bank charge incurred by Chapter 1 resulting from Chapter returning the Deposit to You to an international bank account.

1.12 If the Deposit or part of it is used then unless the Fixed Term has ended, You must restore the Deposit to the full amount before Deductions.

1.13 The Deposit less any Deductions will be returned to You by direct bank transfer within 28 days of this Agreement coming to an end, as long as:

  1. You have moved out and not left anyone else in the Room
  2. You have returned the keys to the Room to Chapter 1 and where applicable all the door entry fobs to Xenia.

Chapter 1 will write and tell You the reason it has made any Deduction from the Deposit as long as You give it a forwarding email address. Alternatively You may ring and ask Chapter 1 the reason for any Deduction within 28 days of this Agreement coming to an end.

2. You and Chapter 1 agree:-

2.1 The Room is used as part of a project which aims to support the values of Chapter 1 and to provide temporary high quality accommodation to students who meet Xenia's eligibility requirements and in particular, students from other countries, who need temporary accommodation whilst studying in the UK.

2.2 The Room is used to further the aims of Xenia, which is a hostel as is defined in section 622 of the Housing Act 1985.

Nature of the Licence

2.3 The Licence does not confer exclusive possession of the Room or any part of Xenia. Chapter 1, its staff and agents, have the absolute right to enter the Room at any time for any reason without notice.

2.4 Nothing in this Agreement shall give to any other person any benefit or the right to enforce any term of this Agreement and You and/or Chapter 1 may vary or end this Agreement without being required to obtain the consent of any other person.

Changing Your Room

2.5 Your Licence allows You to occupy a room at Xenia but not a specific one. So that Xenia can be properly managed and meet the needs of the students, Chapter 1 may require You to move Your Room from time to time without notice or Your agreement. You may have to move rooms for any reason including where Chapter 1 consider it is necessary for the emotional or physical health or safety of any person at Xenia.

2.6 If You wish to change Your Room, this may be done subject to availability. However there will be a charge to cover Chapter 1's administration costs, which must be paid in advance.

Notices

To serve a notice on You

2.7 Any notice which Chapter 1 must serve on You will be validly served if it is addressed to You and posted or delivered to Your Room or handed to You.

To serve a notice on Chapter 1

2.8 You can serve any notice on Chapter 1 if You hand it to Chapter 1 at Xenia.

Chapter 1's obligations

3. Chapter 1 agrees

Possession: Letting You into the Room

3.1 To allow You to occupy a room at Xenia until the Agreement is ended.

Insurance: What Chapter 1 will insure

3.2 To insure the structure of Xenia and any fixtures and fittings owned by Chapter 1 against any risks (for example fire) Chapter 1 reasonably believes it needs to. Chapter 1 will not insure the Contents or Your own fixtures and fittings or Your personal belongings unless such insurance is provided as a Service and set out in Schedule 2.

What you agree to do whilst you are at XENIA

4. You agree:

Possession: Living in the Room

4.1 To move into the Room at the start of the Agreement and to accept and co-operate with Chapter 1 and the aims of Xenia.

Charges

4.2 To pay the Licence Charge when it is due in accordance with the Payment Schedule.

Xenia's Rules

4.3 To comply with Xenia's Rules. A copy of Xenia's Rules is at Schedule 3 but they may be changed by Chapter 1 from time to time to further the aims of Xenia and so that Xenia can be properly managed to meet the needs of the students. Chapter 1 will notify You any new Xenia Rules before they are introduced and will take reasonable account of Your opinion on the new Xenia Rules. You have to follow the new Xenia Rules as and when You are told they are in force.

Changes to personal circumstances

4.4 To immediately notify the Project Manager at Xenia if there is any change to Your personal circumstances set out in Your application form (including but not limited to any change to Your status as a student or Your immigration status).

Outgoings

4.5 To pay all outgoings You are responsible for (such as Council Tax if applicable or a TV licence if You have a TV in Your Room).

Lodgers, assignment visitors and sub-letting

4.6 Not to take in a lodger, assign or part with possession or sub-let the whole, or any part of the Room or any part of Xenia.

4.7 Not to allow any visitor to stay in the Room, Xenia or the Building after midnight or overnight, unless You first obtain the written permission of Chapter 1, which may be refused for any reason. If You are given written permission by Chapter 1, You may be charged an administration fee, which must be paid by You in advance.

4.8 Any visitors present at Xenia or the Building after midnight will be deemed to be staying overnight.

Alterations

4.9 Not to remove or make any alterations to the Room, Xenia, the Building, any fixtures or fittings belonging to Chapter 1 or the Contents.

Use of the Room and Xenia

4.10 Not to keep any candles, cooking, heating or other appliances in the Room.

4.11 That neither You nor Your visitors shall operate a business or any other commercial activity in the Room, Xenia or the Building.

4.12 To keep the Room and the Contents in a good, clean and tidy condition.

4.13 Not to keep any animal, bird, fish, reptile or insect or similar ("Pet") in the Room, Xenia or the Building, unless the Pet is for the assistance of a disabled person (for example a guide dog for blind people, a hearing dog for deaf people or a disability assistance dog for people with other disabilities) (an "Assistance Animal".)

4.14 To notify Chapter 1 in advance if an Assistance Animal is needed at Xenia, as reasonable adjustments may need to be made to accommodate it.

4.15 To be responsible for:

  • the proper care and control of Your Assistance Animal; and
  • any damage or nuisance caused by Your Assistance Animal.

4.16 Not to hold any parties or other social events in the Room, Xenia, the Building, the Communal Areas, the communal lounges or the IT/study rooms, without first getting Chapter 1's consent in writing. Any consent given to You by Chapter 1 may have reasonable conditions attached to it, which You must comply with.

4.17 That You and/or Your visitors will not consume, be in possession of or be under the influence of illegal substances and/or drugs in the Room, Xenia or the Building. You also agree that You and Your visitors will not smoke in the Room, Xenia or the Building.

4.18 That neither You nor Your visitors shall use or threaten to use the Room, Xenia or the Building for any illegal, immoral or unlawful activity.

4.19 That any personal belongings left by You in the communal store rooms at Xenia are at Your own risk. Chapter 1 is not liable for any loss, damage or theft to personal belongings left in the communal store rooms.

Harassment and Nuisance: what You, Your friends and family must not do and whose behaviour You must control

4.20 You must not harass bully or pester anyone else living, working or visiting Xenia or the Building.

4.21 You must not do, threaten to do, or encourage someone else to do anything which causes or it likely to cause or is capable of causing a nuisance or annoyance to anyone else living, working at or visiting Xenia or the Building.

4.22 To be responsible for the behaviour of any person, including children, visiting You.

Graffiti

4.23 That You and/or Your visitors will not graffiti the Room, the Building, or Xenia and/or anything belonging to Chapter 1 and/or any person living, visiting or carrying on a lawful activity in Xenia or the Building.

Damage or Interference

4.24 That You and/or Your visitors will not cause damage to the Room, the Contents, the Building or Xenia.

4.25 That You and/or Your visitors will not tamper with and/or damage security or safety equipment (such as fire and smoke alarms, any equipment for putting out fires, door entry systems and closed circuit systems) in the Room, Xenia or the Building.

4.26 If You or Your visitors cause damage to the Room, the Contents, the Building and/or Xenia then You will pay to Chapter 1 the cost or repairing or replacing what has been damaged within 7 days of Chapter requesting payment from You.

Health and Safety

4.27 Not to keep anything in the Room, Xenia or the Building which may or is likely to cause an explosion.

4.28 To protect Your and other residents' safety and security by:

  • Closing external, safety and fire doors in and to Xenia and the Building; and
  • Controlling and not lending out any key or fob to any Communal Areas

4.29 That You and/or Your visitors will not obstruct or keep or leave rubbish or dangerous materials or belongings which could constitute a heath or fire safety risk in Xenia or the Building.

4.30 That Chapter 1 shall be entitled to remove and dispose of any rubbish, dangerous material or belongings which could constitute a health or fire safety risk in Xenia or the Building.

5. Ending the agreement

Expiry of the Fixed Term

5.1 This Agreement will automatically come to end on the expiry of the Fixed Term.

Early Termination during the Fixed Term

5.2 You are not entitled to end this Agreement before the expiry of the Fixed Term.

5.3 You may apply for release from this Agreement in exceptional circumstances. If You wish to apply for release You must apply to the Project Manager at Xenia giving full details of Your grounds for seeking release. If You are dissatisfied with the decision made by the Project Manager, You may appeal the decision. Details about how You may appeal are available on request from Chapter 1 at the address on page 1 of this Agreement.

5.4 Chapter 1 may end this Agreement before the expiry of the Fixed Term if:-

5.4.1 You no longer meet the eligibility criteria for occupying a room at Xenia, (if for example, You do not have the appropriate permission to reside in the UK because Your immigration visa has expired or been revoked); and/or

5.4.2 You seriously breach the terms of this Agreement. (Examples of serious breach of this Agreement include but are not limited to:

  1. You fail to pay the Licence Charge within 7 days of any due date set out in the Payment Schedule.
  2. You and/or Your visitors have caused serious and/or persistent nuisance to other people who live in Xenia, Chapter 1's staff or agents or any visitors to Xenia or the Building.
  3. Your continuing occupancy would/could pose a threat to Yourself, Chapter 1's staff or agents, or other people who use Xenia or the Building
  4. You and/or Your visitors have caused serious damage to the Room, Xenia or the Building.

5.5 Chapter 1 will end this Agreement before the expiry of the Fixed Term by giving You reasonable notice in writing to end this Agreement (which might be a very short period of time if You are asked to leave because You are violent or disruptive) ("Reasonable Notice").

Termination of Communal Lounge and Study Room Licence

5.6 Chapter 1 can end the Communal Lounge and Study Room Licence by giving You Reasonable Notice if You and/or Your visitors damage or destroy anything belonging to Chapter 1 or cause serious nuisance or annoyance in the communal lounges or the IT/study rooms.

6. Moving out

6.1 That on the date on which this Agreement ends:

  • You will vacate the Room leaving it empty
  • You will remove Your belongings and any Assistance Animal from the Room
  • You will return the keys (and where applicable all the door entry fobs) to the Room and Xenia to Chapter 1 at Xenia's reception by 5pm
  • You will leave the Room and Chapter 1's fixtures and fittings and the Contents in a clean and good condition
  • You will leave the Contents in the Room.

6.2 That after 5pm on the day this Agreement ends, any period which You remain in occupation is an unauthorised occupation (a "period of unauthorised occupation").

For any period of unauthorised occupation You must pay to Chapter 1 an amount equivalent to the Licence fee due for that period of unauthorised occupation immediately.

6.3 That if You do not return the keys (and where applicable all the door entry fobs) by 5pm on the day this Agreement ends You will pay to Chapter 1 the reasonable costs of changing the locks to the Room and replacement locks and key/s and/or door entry fobs immediately.

6.4 That on the day this Agreement ends, if You are in breach of this Agreement , You authorise Chapter 1 to do whatever is necessary carry out such works as are necessary to put right Your breach and/or to dispose of anything You have not taken with You. You agree that You will pay any costs incurred by Chapter 1 in doing this immediately.

6.4 That Chapter 1 is not responsible for anything left in the Room after this Agreement ends.

7. Complaints procedure

7.1 If You think Chapter 1 has not done anything it has agreed to do, You can first make a complaint to the Project Manager at Xenia.

7.2 If You are not satisfied with how Chapter 1's Project Manager has dealt with Your complaint You should then follow Chapter 1's complaints procedure. Details are available on request from Chapter 1 at the address on page 1 of this Agreement.
